Terms governing access to and use of the Hindu Hearts relationship platform

1. Acceptance of these Terms

By creating an account, accessing or using the Hindu Hearts website, web application, mobile application or related services (collectively, the "Platform"), you confirm that you have read, understood and agreed to these Terms and Conditions, the Privacy Policy and Community Guidelines.

If you do not agree, you must not register for or use the Platform. These Terms form a binding agreement between you and Hindu Hearts ("we", "us" or "our").

2. Purpose of the Platform

Hindu Hearts is designed to help Hindu adults connect for the purpose of exploring meaningful relationships based on shared values, culture and mutual respect. The Platform facilitates introductions and communication only.

We do not act as a marriage broker, counsellor, background-check agency, guarantor or representative of any member. We do not guarantee any introduction, match, compatibility, relationship, engagement or marriage.

3. Eligibility

You may use the Platform only if you are at least 18 years old, legally capable of entering into a binding agreement, and not prohibited by law from using dating or relationship services.

By registering, you warrant that all eligibility information you provide is true and that you are using the Platform for genuine, lawful relationship purposes.

4. Registration and Account Security

You must provide accurate, current and complete information and keep it updated. You are responsible for protecting your password, verification codes and devices, and for all activity occurring through your account.

You may not create an account for another person without lawful authority and that person's informed consent. You may not sell, transfer, share or commercially exploit an account.

Notify us promptly at hello@hinduhearts.co.za if you suspect unauthorised access or misuse.

5. Profiles, Verification and Authenticity

We may conduct limited checks, request identity or contact verification, review profile content, or apply verification badges. Any verification measure is limited and is not a guarantee of identity, background, marital status, intentions, character, safety or authenticity.

You remain responsible for independently assessing other members and deciding whether and how to communicate or meet.

6. Member Conduct and Prohibited Activities

You must treat other members with dignity and respect and comply with all applicable laws and Community Guidelines. You must not:

  • provide false, misleading or impersonated information, use stolen photographs, conceal a material identity fact, or misrepresent your relationship status;
  • harass, threaten, stalk, shame, discriminate against, exploit or abuse another person;
  • solicit money, gifts, banking details, investments, cryptocurrency, employment fees or financial assistance;
  • publish sexual, violent, hateful, defamatory, unlawful or non-consensual content;
  • share another person's private information, messages, images or contact details without permission;
  • use automated tools, scraping, bots, malware or security bypasses, or interfere with Platform operation;
  • use the Platform for prostitution, trafficking, commercial sexual services, fraud, advertising, recruitment, political campaigning or unrelated commercial activity;
  • communicate with minors or create content that sexualises or endangers a minor; or
  • circumvent a suspension, ban or safety restriction.

7. Safety and Offline Meetings

Online and offline interactions involve risk. Exercise independent judgment, do not send money or sensitive financial information, and be alert to fraud, coercion and identity deception.

For first meetings, use a public place, arrange your own transport, tell a trusted family member or friend where you will be, keep your phone available, and leave immediately if you feel unsafe. In an emergency, contact the appropriate emergency services or law-enforcement authority.

8. User Content and Licence

You retain ownership of lawful profile information, photographs, messages and other material you submit ("User Content"). You grant Hindu Hearts a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display and transmit your User Content only as reasonably necessary to operate, secure, moderate and improve the Platform.

You warrant that you have the rights and permissions needed for all User Content. We may remove or restrict content that violates these Terms, the law, third-party rights or community safety.

9. Privacy and Sensitive Personal Information

Your use of the Platform is also governed by our Privacy Policy. Because the Platform concerns religion, relationships and potentially sexual orientation, some information may constitute special personal information under South African privacy law. We process such information only on an appropriate lawful basis, including explicit consent where required.

You choose what optional profile details to disclose. Do not place highly sensitive information in public profile fields or messages unless necessary and safe.

10. Memberships, Fees and Renewals

Free and paid features, subscription periods, prices and benefits will be displayed before purchase. Unless clearly stated otherwise, fees are charged in South African rand and include or exclude VAT as displayed at checkout.

Nothing in these Terms limits rights that cannot lawfully be excluded under the Consumer Protection Act or other applicable law.

11. Cancellation, Suspension and Termination

You may delete or request closure of your account by contacting hello@hinduhearts.co.za. Some information may be retained where reasonably required for legal, fraud-prevention, security, dispute or regulatory purposes.

We may refuse registration, restrict features, remove content, suspend or terminate an account where we reasonably believe there is a breach of these Terms, fraud, safety risk, unlawful conduct, misuse, non-payment or harm to members or the Platform. Where reasonably possible and legally appropriate, we may provide notice or an opportunity to respond.

12. Reporting and Complaints

Report suspicious, abusive, misleading or unsafe conduct using the in-app reporting tool or by contacting hello@hinduhearts.co.za. We may investigate, preserve relevant evidence, restrict accounts and cooperate with lawful authorities, but we do not promise a particular outcome or response time.

13. Intellectual Property

The Hindu Hearts name, branding, Platform design, software, databases, text and non-user content are owned by or licensed to us and are protected by applicable intellectual-property law. No rights are granted except the limited right to use the Platform in accordance with these Terms.

14. Third-Party Services

The Platform may rely on payment processors, hosting providers, analytics, identity-verification services, messaging tools or external links. Third-party services are governed by their own terms and privacy practices. We are not responsible for third-party systems beyond the extent required by applicable law.

15. Availability and Changes

We aim to provide a reliable service but do not guarantee uninterrupted, error-free or permanently available access. We may update, improve, restrict or discontinue features for operational, legal, security or commercial reasons.

We may amend these Terms by publishing an updated version and effective date. Material changes may also be communicated through the Platform or by email. Continued use after the effective date constitutes acceptance, subject to applicable law.

16. Disclaimers

To the fullest extent permitted by law, the Platform is provided on an "as available" basis. We do not guarantee the accuracy, completeness or authenticity of profiles, or the intentions, behaviour, compatibility, health, financial position or relationship status of any member.

You acknowledge that you use the Platform and interact with members at your own risk. No disclaimer excludes any warranty, duty or right that may not lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, Hindu Hearts and its owners, employees and service providers will not be liable for indirect, incidental, special or consequential loss arising from use of the Platform or interactions between members, including emotional distress, lost opportunity, reputation loss or data loss.

Our liability will not be excluded or limited where doing so would be unlawful, including liability arising from gross negligence, wilful misconduct, or rights that cannot be excluded under consumer law.

18. Indemnity

To the extent permitted by law, you agree to indemnify Hindu Hearts against third-party claims, losses and reasonable costs resulting from your unlawful conduct, User Content, infringement of rights, fraud or material breach of these Terms.

19. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa. The parties should first attempt in good faith to resolve a dispute through written notice and reasonable negotiation.

Subject to any mandatory consumer rights and jurisdictional rules, disputes may be brought before a competent South African court.

20. General Provisions

If any provision is held invalid or unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. You may not transfer your rights without our consent; we may transfer the agreement as part of a lawful restructuring, sale or service transition, subject to applicable law.

These Terms, the Privacy Policy, Community Guidelines and any purchase-specific terms constitute the agreement relating to the Platform.
